So that you understand how we operate to protect this information, the following is a description of our policies on collecting and protecting the information you provide to us in your Account (as defined below).
How OTTO Works
The Company's Site is used by (a) you; and (b) our partners, principally ski areas, their snowsports schools and snowsports instructors (collectively, "Ski Areas") in the course of providing snowsports instruction.
Your Account Profile
When you create an Account and your profile, you provide certain information called "PII" (as defined below). Ski Areas use your profile and its PII in the delivery of snowsports instruction and for follow-on communication after your snowsports lesson. Your PII is not made available to other Platform users or to the Internet at large and is only available to participating Ski Areas.
If you are a snowsports instructor, you will also create an Account with a profile. However, your profile will be viewable by snowsports school customers or their parents or guardians. In this sense, the PII contained in your profile is available to a wider audience than other Platform users.
Types of Information that we Collect
- Personally Identifiable Information ("PII"). Generally, the PII we may collect includes your name, your contact information, answers to general questions about physical characteristics (e.g., height and weight), recreational activities (e.g., what other sports do you enjoy), and snowsports history (e.g., how long have you been skiing or riding and how often to you ski or ride). We collect PII when you provide it to us through your OTTO Account. Your PII may also include video content you supply to your profile or which is supplied by a Ski Area as feedback from a lesson. We also receive limited PII when you choose to download or request our mobile application. We may combine the PII we collect with additional information from other third-party sources.
- Data that is not associated with or linked to your PII ("Anonymous Information"). Anonymous Information does not, by itself, permit the identification of individual persons.
- Text, data, pictures or any of your Content (as defined below) that you post via the Site.
- Your user name, password information, and associated PII used to create a profile on the Site (collectively your "Account").
- Information about your geographic location.
- If you provide us feedback or contact us via e-mail, we will collect your name and e-mail address, as well as any other Content included in the e-mail, in order to send you a reply.
- When you participate in a surveys, contests and/or promotions we may collect additional PII.
- We may also collect additional PII, such as at other points in the Site that state or otherwise indicate that PII is being collected.
Use of Your Information
The Company does not sell, rent or provide your PII to other third parties, except as described below.
Personally Identifiable Information ("PII"). PII collected by the Company is used by Ski Areas. This personal information is used by participating Ski Areas in the delivery of snowsports instruction that you may purchase and for follow-on communication after your snowsports lesson. Your PII is not made available to other Platform users or to the Internet at large and is only available to participating Ski Areas. However, if you are a snowsports instructor, your Account profile may be viewed by other Platform users who are Ski Area customers.
PII is personal to you in that it belongs to you and identifies who you are. There are a variety of pathways, electronic and otherwise, by which any single element of these data can point to you personally. PII does NOT include your IP Address as defined below. PII is generally kept for Company business which is primarily used to assist you in your current or future communications and/or transactions using the Site.
PII may also be used to analyze and improve the Site and to conduct marketing. If you register for email or if you provide your email address to us, you may receive emails about a variety of topics, including promotional offers and lesson follow-up communications from us, participating Ski Areas and/or other selected business partners. Please see below for your choices regarding how we collect, use, and share your PII.
We may share email activity data with a marketing email provider to help them better target email deployments to consumers. While a marketing email provider may have access to email address and email activity and may share bulk/non-specific activity data, no email addresses or specific email actions may be shared with other third parties. Should a consumer wish to opt out of this possible sharing, that consumer simply needs follow the opt out instructions in the "Your Choices" section below.
Content and Material Submitted or Received by You. Any comments, reviews, posts, feedback, questions, answers, notes, messages, images, video, audio, materials, ideas, suggestions or anything else that you submit or which is received from a Ski Area before, during or after a snowsports lesson by you via the Site (collectively "Content") are not private or proprietary, since the information will be shared with Ski Areas and other partners to deliver snowsports instruction or related websites and/or mobile applications. If there is information that you do not want to be visible to us or any of our partners, please do not post or otherwise submit it via the Site.
Geographic Location. Our Site may use the GPS feature of your mobile device to determine the device's location. We and our third-party vendors or partners may collect and use this geographic location data for purposes such as the functioning of the Site, to make advertising more relevant, and to improve Site. For example, we may use the location information to provide the address and directions for the nearest snowsports school. We do not currently store geographic location data in combination with PII.
Anonymous Information. We may automatically collect certain Anonymous Information when you use Site. For example, we collect information about the devices you use to connect to our Site (such as the IP address of your computer or numeric identifier of your mobile device) and about how you use Site (such as what time you visit our website). We, and our advertisers, sponsors and/or ad servers, may also collect Anonymous Information outside the Site to measure the success of our advertising campaigns. We use the Anonymous Information that we collect for a variety of purposes such as to provide and improve the Site, and to analyze and offer our advertising.
Anonymous Information may be used to analyze request and usage patterns so that we may enhance and improve the Site and/or platform navigation. We reserve the right to use Anonymous Information for any purpose and disclose Anonymous Data to third parties at its sole and absolute discretion.
Behavioral Remarketing. The Site may also use third-party analytics vendors such as Google Analytics. You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page. Google also recommends installing the Google Analytics Opt-out Browser Add-on, which provides visitors with the ability to prevent their data from being collected from your web browser and used by Google Analytics. We and our third-party vendors or partners may use analytics data for a variety of purposes such as to improve the design and content of our Site, to help us learn things like what pages are most attractive to all of our visitors and what promotions visitors like to see, and to gauge the success of our advertising campaigns.
Law Enforcement. We may disclose PII if we believe in good faith that such disclosure is necessary:
- in connection with any legal investigation;
- to comply with relevant laws or to respond to subpoenas or warrants served on us;
We may use PII to get in touch with you when necessary. Users may opt-out of receiving future mailings by following the directions in those mailings.
Your PII. Like the information you provide to schedule a snowsports lesson with a Ski Area, you have the option to change or correct your information and the choice of not sharing that information with that Ski Area again. There are several ways you can control our use of your PII in connection with marketing and promotions.
To remove your name from our lists. You can choose to decline communications from us at the point that we request your PII. After we have collected your PII, you can choose to stop our communications or our Site, or stop us from sharing your information with other companies for their marketing purposes. To exercise any of these options, please contact us by mail or email using the contact information below.
To stop email communications. If you receive email communications from us or any of our partners, and want to opt out of receiving such communications in the future, you can click the "Unsubscribe" link at the bottom of the promotional email.
To stop collection of geographic location. If you do not want us to collect your device's geographic location through the Site, you can disable that function when you first use the mobile application or in your device settings. However, disabling such features on your device will prevent you from using some features of the Site.
Correcting or Updating your Information
If you would like to request changes to the PII that you have previously provided to us, please contact us by mail or email using the contact information below.
Cookies and Other Information Collected by Technology
"Cookies" are small pieces of information that a website sends to your computer's hard drive or device while you are viewing a website. We may use both "Session Cookies" (which expire once you close your Web browser) and "Persistent Cookies" (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on the Site. Persistent Cookies can be removed by following your Internet browser's help file directions.
To make our Site more useful to you, our servers (which may be hosted by a third party service provider) collect "Log Data." Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Site that you visit, the time and date of your visit, the time spent on those pages and other statistics.
Most browsers accept cookies automatically. However, if you reject or delete cookies this will disable features of the Site or other websites you visit. We recommend that you leave cookies "turned on" so that the Platform and Site will operate.
While the Site is intended for the use of individuals of all ages, only persons age 18 or older have permission to access and use our Site without parental consent. If a parent or guardian creates an Account for a minor, the minor is permitted to use the Site, but the parent or guardian is the primary Account holder. As such, for skiers and riders under the age of 18, we require a parent or legal guardian to establish an Account on their behalf. That parent or guardian will be the primary contact on such an Account. We reserve the right to deny any user Account applications where no parent or legal guardian is a co-applicant.
We do not knowingly collect personally identifiable information directly from persons under the age of 18. If you are a parent or guardian and you learn that your child or children under the age of 18 have provided us with PII, please contact us. While we are not under any obligation to actively monitor our Site for such information, if we become aware that we have inadvertently collected PII from a person under the age of 18, without verification of parental consent, we will do our best to remove that PII from our servers in a timely manner.
Links to Third Parties and Social Media
Our Site may contain links to third-party online properties, including without limitation social media platforms. Such third parties have their own policies that govern their collection, use, and disclosure of information. We therefore have no responsibility or liability for the content and activities of these third parties and/or social media platforms. We suggest that you read their privacy policies carefully to learn about their practices.
Security of Your Information
We are committed to protecting the security of your PII. We use a variety of industry-standard security technologies and procedures to help protect your PII from unauthorized access, use, or disclosure. We also require you to enter a password to access your Account information. It is your responsibility to protect against unauthorized access to your password and to your computer. Please do not disclose your Account password to unauthorized people and be sure to sign off when finished using a shared computer. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we use reasonable efforts to protect your Profile Data, we cannot guarantee its absolute security.
